A federal appeals court this week ruled that a lawsuit filed by a candidate for teaching positions at the University of Iowa's College of Law could proceed.
A lower court had dismissed the lawsuit, saying that a dean could hire whomever she wanted.
Teresa R. Wagner alleges that Carolyn Jones, former dean of the College of Law, “discriminated against her in violation of her First Amendment rights of political belief and association” when Wagner was not hired to be a full-time instructor or part-time instructor at the college when she applied for these jobs in 2006-07, according to court documents.
Wagner argued that Jones discriminated against her because of her conservative political beliefs and activism, which included opposition to abortion and euthanasia.
