Judge blocks new rule that could limit access to HIV drug assistance (Dispatch)

A Franklin County judge has temporarily blocked the state from enacting a new rule that AIDS patients say could prevent them from getting life-saving medicine.

Common Pleas Judge Timothy S. Horton yesterday issued a preliminary injunction stopping the Ohio Department of Health from changing the Ohio HIV Drug Assistance program, the state’s version of the federal Ryan White program.

The new rule, which was to have taken effect earlier this month, would reduce eligibility to individuals at 100 percent of the poverty level from the current 300 percent. It would also affect medical guidelines related to a priority waiting list for medications and treatment.
