To the Editor:
Much of what has been said and written recently about the retention of three Iowa Supreme Court Justices in the upcoming election is misleading. A group calling itself Iowa for Freedom has sponsored ads claiming the justices have exceeded their authority and legislated from the bench. This is simply not true.
Each branch of the government has its function the Legislature drafts laws; the executive (governor) carries them out; and the judicial branch interprets the laws and rules on whether those laws are being violated including when the legislature violates the supreme law of Iowa - its constitution. The Justices did not usurp the right of Iowans to vote. They can't. If we don't like their interpretation of the constitution, we can vote to amend it. The proper process is not a retention vote.
